hi all,i was summoned by one of my creditors to go to court Monday for the preliminary hearing. the court appointed attorney there said to request a documentation of debt from my creditors, and i should win the case. does anyone know anything about this and if so, could you describe the kind of letter to send them? the attorney also said that when i do request this that the creditor won’t have any of the info that i am requesting and the judge will probably dismiss this. i also receive social security disability payments and live in N.Y.S Thank you for any help with this.

Your court appointed attorney should be helping you with this. It’s a strategy called “produce the note” which means you are asking the lender or servicer to prove to the court that they have the documentation proving they are the holder of the mortgage note. It’s a fairly complicated process, but it is effective in many cases.
